“Cabernet”Trademark Verdict Rejected by Industrial Enterprises

On May 26th,2008, China Administration for Industry and Commerce ruled that the trademark right of “Cabernet” is exclusively owned by Changyu Winery Group, any other enterprise can not employ "Cabernet" as brand name.

However, the judge was rejected by a lot of wine enterprises. China Great Wall Winery, Dynasty Fine Wines Group Limited and Yantai Weilong Grape Wine Co. appealed to the No.1 Intermediate People's Court of Beijing Municipality on July 13th.

On July 16th, 12 domestic wine enterprises, including Great Wall, Dynasty, Weilong , Suntime, declared a manifesto of“Preserve public industrial resource, Protect consumers' legal rights”.

It is reported that a lot of “canbernet” wines not belonging to Changyu Winery had been pulled off the shelves in many supermarket, chain-stores, which made industrial enterprises suffering great damages. For example, Great Wall “ cabernet ” had been taken off the shelf in Wal-mart.

About Changyu “Cabernet”

Aaccording to the introduction of Chinese Trademark Association , Changyu Winery Group has established the trademark “Cabernet”in 1931, and applied for the registertation of the name to the government in 1936. In 1937, the trademark of “Cabernet” is ratified with the registertation number 33477.

CHINA ALCOHOLIC DRINKS INDUSTRY ASSOCIATION said that Changyu Winery has employed the name of “cabernet” as trademark since 1930s. Changyu “ cabernet ” is the blending of Cabernet Sauvignon, Cabernet franc and Cabernet Gernischt.
